Welcome to Pivelia. By accessing or using our website at pivelia.com (the “Platform”) and any related services, products, or content made available through the Platform (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Service.
The Service is owned and operated by Pivelia Health and Beauty LLC (“Pivelia,” “we,” “us,” or “our”), a limited liability company organized under the laws of the State of Florida.
1. Overview of the Service
Pivelia is a wellness and telehealth platform that connects users with licensed healthcare providers (“Providers”) for personalized wellness and treatment plans. The Service may include:
- Online health assessments and wellness questionnaires
- Physician-reviewed and supervised treatment programs
- Prescription medications dispensed by licensed pharmacies
- Non-prescription wellness products, including sublingual strips
- Educational health and wellness content
Pivelia does not itself provide medical advice, diagnose conditions, or prescribe medications. All clinical decisions are made independently by licensed Providers based on their professional medical judgment. Pivelia facilitates the technology platform and administrative services that enable you to connect with Providers and receive products.
2. Eligibility
The Service is intended for individuals who are at least eighteen (18) years of age and reside in the United States. By using the Service, you represent and warrant that you meet these eligibility requirements. We reserve the right to refuse service to anyone who does not meet these criteria.
3. Account Registration
To access certain features of the Service, you may be required to create an account and provide personal and health information. You agree to provide accurate, current, and complete information during the registration and assessment process and to update such information as necessary.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Providing false, misleading, or incomplete health information may result in inappropriate treatment recommendations, could endanger your health, and may result in the termination of your account.
4. Telehealth Services and Medical Disclaimer
The Service uses telehealth technology to facilitate consultations between you and licensed healthcare Providers. Telehealth involves the delivery of healthcare services using electronic communications and information technology when you and your Provider are not in the same physical location.
You understand and acknowledge that:
- Telehealth is not a substitute for in-person medical care in all cases
- A Provider may determine that your condition is not suitable for telehealth and may refer you to in-person care
- Not all patients will qualify for every treatment or medication
- Results vary by individual and are not guaranteed
- Technical failures may occur that prevent or delay your consultation
In the event of a medical emergency, you should call 911 or go to the nearest emergency room immediately. Pivelia is not an emergency medical service provider.
5. Prescription Medications
Certain products available through the Service require a valid prescription from a licensed Provider. You will not receive a prescription product unless a Provider has reviewed your health assessment and determined that the product is medically appropriate for you.
Prescription medications offered through the Platform are compounded by licensed pharmacies. Compounded medications are not FDA-approved. The FDA does not verify the safety, effectiveness, or quality of compounded medications before they are marketed. You acknowledge this and accept the associated risks.
You agree not to share, transfer, sell, or distribute any prescription medication you receive through the Service to any other person.
6. Wellness Products
Non-prescription wellness products offered through the Service, including sublingual strips, are intended for general wellness support. These products are not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the Food and Drug Administration.
7. Payments and Subscriptions
All payments are processed securely through our third-party payment processor. By purchasing a product or program, you agree to pay the applicable fees at the prices displayed at the time of purchase. All prices are in U.S. dollars.
For multi-month programs, the total program cost is charged at the time of enrollment unless otherwise stated. Pricing and availability of products and services are subject to change without prior notice.
You are responsible for all charges incurred under your account, including any applicable taxes and shipping fees.
8. Refunds and Cancellations
Our refund and cancellation policies are described in our Refund and Return Policy, which is incorporated into these Terms by reference. By making a purchase through the Service, you agree to the terms of our Refund and Return Policy
9. Shipping and Delivery
Products are shipped in discreet, unmarked packaging. Temperature-sensitive medications are shipped with appropriate cold chain packaging. We are not responsible for shipping delays caused by carriers, weather events, incorrect addresses provided by you, or other circumstances beyond our reasonable control.
Risk of loss and title for products pass to you upon delivery to the shipping carrier.
10. User Conduct
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. You agree not to:
- Provide false or misleading information in any health assessment or registration
- Attempt to obtain medications for which you are not eligible
- Use the Service on behalf of another person without authorization
- Interfere with or disrupt the Service or its servers
- Reproduce, distribute, or create derivative works from any content on the Platform
11. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, images, software, and design, are the exclusive property of Pivelia Health and Beauty LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
“Pivelia” and our logo are trademarks of Pivelia Health and Beauty LLC. You may not use our trademarks without our prior written permission.
12. Privacy
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your personal and health information. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.
13. Disclaimer of Warranties
THE SERVICE AND ALL PRODUCTS AND SERVICES PROVIDED THROUGH THE SERVICE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PIVELIA DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Pivelia does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PIVELIA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE.
PIVELIA’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO PIVELIA FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
15. Indemnification
You agree to indemnify, defend, and hold harmless Pivelia Health and Beauty LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another person or entity; or (d) any content or information you provide through the Service.
16. Dispute Resolution
These Terms and any disputes arising from or related to them or the Service shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration administered in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association.
You agree that any arbitration or legal proceedings shall be conducted on an individual basis and not as a class action or collective proceeding.
17. Modifications to the Service and Terms
Pivelia reserves the right to modify, suspend, or discontinue the Service, or any part thereof, at any time without notice. We also reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, Refund and Return Policy, and Wellness Disclaimer, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
